1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Tulip Advanced Aesthetic & Medical ("Tulip," "we," "us," or "our"), governing your access to and use of our website at www.tulipmd.com and your receipt of any services provided at our medical spa located at 11600 Wilshire Blvd, Suite 516, Los Angeles, CA 90025.
By accessing our website, submitting an appointment request, or receiving any service from Tulip, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please discontinue use of our website and services immediately.
We reserve the right to modify these Terms at any time. Continued use of our website or services following notice of any changes constitutes your acceptance of the updated Terms.
2. Eligibility
To receive services at Tulip Advanced Aesthetic & Medical, you must:
- Be at least 18 years of age, or be accompanied by a parent or legal guardian who consents to treatment on your behalf
- Provide accurate, complete, and current information during the intake and consultation process
- Disclose all relevant medical history, medications, allergies, and health conditions prior to any treatment
- Not be under the influence of alcohol or controlled substances at the time of your appointment
We reserve the right to refuse service to any individual at our sole discretion, including but not limited to situations where we determine that a requested treatment is not medically appropriate or safe for the client.
3. Services Offered
Tulip Advanced Aesthetic & Medical offers a range of non-surgical aesthetic and medical spa services, including but not limited to:
- Botulinum toxin injections (Botox, Dysport, Xeomin, Jeuveau)
- Dermal fillers (Restylane, Juvederm, Voluma, RHA Collection, and others)
- Platelet-Rich Fibrin (PRF) hair restoration and skin rejuvenation treatments
- Laser hair reduction
- HIFU skin tightening
- Laser fractional RF micro-needling
- Thread lift procedures
- Liquid facelift (combination neuromodulator and filler treatments)
All services are performed by or under the supervision of licensed medical professionals. The availability of specific treatments may change without notice. Not all services are appropriate for all clients; suitability is determined during your consultation.
4. Appointments and Scheduling
4.1 Booking
Appointments may be scheduled by contacting us via phone at (424) 468-7065, by email at medspa@tulipmd.com, or through the appointment request form on our website. Submitting a request does not guarantee a confirmed appointment; you will receive confirmation from our staff.
4.2 Cancellations and Rescheduling
We ask that you provide at least 24 hours' notice if you need to cancel or reschedule your appointment. Late cancellations or no-shows may be subject to a cancellation fee at our discretion. Repeated no-shows may result in a requirement for a deposit to book future appointments.
4.3 Arrival
Please plan to arrive 10–15 minutes prior to your scheduled appointment to complete any required intake paperwork. Late arrivals may result in a shortened treatment time or the need to reschedule your appointment.
4.4 Right to Refuse or Modify Treatment
Our providers reserve the right to decline to perform, modify, or discontinue any treatment at any time if, in their professional judgment, it is not safe, appropriate, or in your best interest. This decision will be communicated to you clearly and respectfully.
5. Informed Consent
Prior to receiving any treatment, you will be asked to review and sign an informed consent form specific to the procedure(s) you are receiving. Informed consent is a fundamental part of our practice and includes:
- A description of the proposed treatment, including its purpose and how it is performed
- Known risks, side effects, and potential complications
- Expected outcomes and realistic limitations of results
- Available alternatives to the proposed treatment
- Your right to ask questions and withdraw consent at any time prior to the procedure
By signing an informed consent form, you confirm that you have been provided with this information, that your questions have been answered to your satisfaction, and that you voluntarily agree to proceed with the treatment. Electronic consent may be used where applicable.
6. Medical Disclaimer and No Guarantee of Results
The treatments and information provided by Tulip Advanced Aesthetic & Medical are intended for aesthetic and wellness purposes and do not constitute the practice of medicine in a clinical or diagnostic sense unless expressly stated. All services involving injectables, laser, or other medical-grade procedures are performed by or under the direct supervision of a licensed medical professional.
Individual results vary. Tulip makes no guarantee, warranty, or representation that any specific outcome, result, or improvement will be achieved from any treatment. Factors including skin type, lifestyle, age, health status, and adherence to aftercare instructions may significantly affect results. Any before-and-after photographs or testimonials displayed are representative examples and are not a guarantee of your specific results.
The content on our website, including treatment descriptions, is for informational purposes only and is not intended as medical advice. Always consult a qualified healthcare professional before making decisions about your health or aesthetic treatments.
7. Payment and Fees
7.1 Payment Policy
Payment for services is due at the time of treatment unless otherwise agreed in writing. We accept major credit cards, debit cards, and other payment methods as posted at our office. Prices are subject to change without prior notice.
7.2 Deposits
Certain treatments or first-time appointments may require a deposit at the time of booking. Deposits are applied toward the cost of your treatment. Deposits may be forfeited in the event of a no-show or late cancellation as described in Section 4.2.
7.3 Insurance
The aesthetic and cosmetic services we offer are generally not covered by health insurance. It is your responsibility to understand your insurance coverage. Tulip Advanced Aesthetic & Medical is not responsible for any insurance claims, denials, or reimbursement disputes.
7.4 Promotional Offers
From time to time, we may offer special promotions, packages, or discounts. Promotional offers are subject to specific terms and expiration dates and may not be combined with other offers unless expressly stated. We reserve the right to discontinue any promotion at any time.
8. Refund Policy
Due to the nature of aesthetic and medical services, all sales are generally final. We do not offer refunds on completed treatments. If you have a concern about your treatment outcome, we encourage you to contact us promptly so we can address it with a complimentary consultation or, at our discretion, a follow-up treatment.
Refunds on unused pre-paid service packages may be considered on a case-by-case basis and are subject to an administrative fee. Gift cards and vouchers are non-refundable and non-transferable unless required by California law.
9. Photography and Likeness
With your prior written consent, we may take before-and-after photographs for the purpose of documenting your treatment progress and, where you have separately consented, for use in marketing, educational, and promotional materials, including our website and social media channels.
You may withdraw your consent for marketing use of your photographs at any time by contacting us in writing at medspa@tulipmd.com. Withdrawal of marketing consent does not affect the use of photographs for clinical record-keeping purposes, which is governed by our Privacy Policy and HIPAA.
10. Website Use and Intellectual Property
10.1 Permitted Use
You may access and use our website for personal, non-commercial purposes only. You agree not to use our website in any manner that is unlawful, harmful, fraudulent, or that could damage, disable, or impair the website or interfere with other users' access.
10.2 Intellectual Property
All content on www.tulipmd.com, including but not limited to text, graphics, logos, images, photographs, and software, is the property of Tulip Advanced Aesthetic & Medical or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our express written permission.
10.3 Third-Party Links
Our website may contain links to third-party websites. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy practices, or accuracy of any third-party site. Your use of any third-party site is at your own risk.
11. Client Conduct
We are committed to maintaining a safe, respectful, and professional environment for all clients and staff. By visiting our office or using our services, you agree to:
- Treat all staff and other clients with courtesy and respect
- Refrain from any behavior that is abusive, threatening, harassing, or discriminatory
- Comply with all posted office policies and staff instructions
- Disclose any changes in your health status, medications, or relevant circumstances prior to each visit
Tulip Advanced Aesthetic & Medical reserves the right to refuse service to, or remove from the premises, any individual whose conduct is disruptive, threatening, or otherwise contrary to a safe and professional environment, without refund.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Tulip Advanced Aesthetic & Medical, its owners, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, including but not limited to:
- Dissatisfaction with aesthetic outcomes
- Allergic reactions or side effects disclosed in your informed consent
- Loss of data or unauthorized access to information outside our reasonable control
- Interruptions in website availability or functionality
Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount you paid for the specific treatment giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Tulip Advanced Aesthetic & Medical and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your use of our website or services; (b) your violation of these Terms; (c) your provision of false, inaccurate, or incomplete information; or (d) your violation of any applicable law or the rights of any third party.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact us in good faith at medspa@tulipmd.com to attempt to resolve the dispute informally. We will make reasonable efforts to resolve any concern within 30 days of receiving written notice.
14.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
14.3 Waiver of Class Action
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy and any signed consent forms or service agreements, constitute the entire agreement between you and Tulip Advanced Aesthetic & Medical with respect to your use of our website and services, and supersede all prior agreements, understandings, and communications.
15.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be made in writing and signed by an authorized representative of Tulip Advanced Aesthetic & Medical.
15.4 Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our practice without restriction.
